Subject to “Subscribers” acceptance of the Terms of Service set forth in this Agreement (as evidenced by “Subscribers” acceptance of this agreement and the submission of an application membership) and the payment of all required membership fees, Lily White Productions, LLC (“the Company”) agrees to provide to “Subscriber” all the privileges of Membership including access to the Members-only materials of the Website which are available to a “Subscriber” in good standing.

“For "subscriber" to complete your purchase "Subscriber"  will be transferred to the secured server of  CC Bill (“Service Provider”), independent companies providing credit card and check processing services and other billing services Lily White Productions, LLC, such as the owner and operator of this Web Site. CC Bill nor any person or company related to CC Bill holds any ownership interest in this Web Site, nor receives any financial benefit from this Web Site, other than a fee paid by the owner of this Web Site to CC Bill for the services performed by stipulated Company. CC Bill HAS NO CONTROL OVER THE WEB SITE, or any of the design, layout, content, subject matter, products, services or persons that appear in or on or that are linked to the Web Site, or the geographical areas into which it may disseminate, broadcast or permit the downloading of or access to the content or services offered by www.lesbianfilm.net. CC Bill makes absolutely no representations and/or warranties, and provides no assurances, regarding www.lesbianfilm.net, the Web Site owner, or the quality, availability, legality or description of the products and/or services offered thereon. CC Bill EXPRESSLY DISCLAIMS ANY WARRANTIES OF LILY WHITE PRODUCTIONS, LLC’S ABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO WWW.LESBIANFILM.NET AND/OR THE PRODUCTS AND SERVICES OFFERED HEREON. Any disputes arising in connection with www.lesbianfim.net, or the products and/or services being offered or purchased, are between you, the "Subscriber"  and the owner of www.lesbianfilm.net. In certain circumstances, CC Bill may provide billing customer service for the Web Site, in which case CC Bill may be handling such disputes for the owner on a contract basis, but without any liability therefore. In all other cases, disputes should be directed to the contact information contained on www.lesbianfilm.net; however, you, the "Subscriber" should feel free to contact CC Bill in the event that you feel that www.lesbianfilm.net acted fraudulently, or you were misled in any way. Service Provider urges you to carefully read the Terms and Conditions on the Web Site, and to ask the www.lesbianfilm.net  any questions you, "the "Subscriber", may have regarding the service/product before completing the subscription or other transaction, by using the contact information on this Web Site. By submitting your request for authorization of your transaction, you, the "Subscriber", acknowledge having read, understood and agreed to the terms and conditions herein stated, AND agree to indemnify, defend, and hold CC Bill harmless from any and all liabilities, damages (including attorneys fees and associated costs) and other costs and expenses arising in connection with your visit to or use of www.lesbianfilm.net, and/or your purchase or offer to purchase any of the products and services offered hereon.”

www.lesbianfilm.net is an online subscription service (the "Service") owned and operated by Lily White Productions, LLC ("the Company"). Please carefully read and understand these Terms Of Service prior to becoming a subscriber to the Service, as they establish a binding legal agreement (the "Agreement") by and between Lily White Productions, LLC and persons who elect to become subscribers to the Service (the "Subscribers").

1. As a Subscriber to the Service, you agree to be bound by every stipulation included in this Agreement (the "Agreement"). This Agreement may be changed or amended by Lily White Productions, LLC, at any time, and changes are effective upon notice to each Subscriber. Notices by Lily White Productions, LLC to Subscribers may be given via electronic messages via a posting within this Agreement.

2. Subscribers will be charged a subscription fee for the Service, in agreement with Lily White Productions, LLC's then-current billing terms. In consideration of the payment of membership fees, together with certain representations and agreements made by Subscriber under the Terms of Service of this Agreement, and subject to the Terms of Service set forth in this Agreement, Lily White Productions, LLC hereby grants the Subscriber a limited, nonexclusive and nontransferable license to use the materials contained in, or made available through www.lesbianfim.net (hereafter “Materials”) solely for Subscriber’s private personal non-commercial use, as provided by Lily White Productions, LLC during the period in which Subscriber is a Member in good standing. Subscriber shall not be entitled to any pro-rated or partial refund if Subscriber should cancel membership before the end of the then current membership period. Subscriber agrees that if Subscriber cancels at any time after purchasing a membership to www.lesbianfilm.net (e.g., 20 minutes after you sign up), Subscriber will still be charged the full membership fee. Subscriber will be allowed access into Website after having cancelled membership if the full time period of membership has not elapsed yet.

3. Subscription to the Service will NOT be automatically renewed for the original term upon expiration of such term. But it is the Subscriber’s sole responsibility to cancel a membership before its expiration period elapses via our Customer Service Area link:

(a) 7 DAY memberships will NOT automatically renew to a full membership after signup. But Membership cancellation is the Subscriber’s full responsibility and Subscribers must provide proof of such cancellation via a cancellation confirmation number.
(b) Cancellation for membership may ONLY be accomplished via the online Lily White Productions, LLC Customer Service link provided on every page of the website. This service is available 24 hours a day, seven days a week. Upon cancellation of Subscriber’s account, Subscriber will be given a Cancellation Confirmation Number for Subscriber’s records.

4. Until such time as this Agreement is terminated in agreement with its provisions, Subscriber agrees to pay his/her/its subscription fee by credit card (or other approved facility or mechanism), and hereby grants permission to Lily White Productions, LLC to charge Subscriber's credit card (or other approved facility or mechanism) for the subscription fee, and for any and all purchases or products and/or services purchased by Subscriber from the Service. Subscribers using our ACH or Online check payment system also acknowledge that if payment is returned unpaid for “NSF” or “Insufficient Funds”, the Subscriber is responsible for the unpaid transaction, plus a “Returned Item Fee” of $20.00 will be electronically debited from the Subscriber’s bank account. Subscriber will be billed by the financial transaction company Lily White Productions, LLC utilizes, CC Bill, and any financial recordings will state this name on the transaction.

5. Subscriber agrees that as a Member of the Website Subscriber shall not, under any circumstances, have the right to transfer or assign Subscriber’s membership to any other person or entity, and that any attempted transfer or assignment of a membership shall be void.

6. Subscriber agrees to immediately notify Lily White Productions, LLC of any of the following changes in his/her/its credit card account: Card loss or theft, or unauthorized usage of the card; apparent breach of security of Subscriber ID or password, such that unauthorized access to the Service via the card is possible. Unless Subscriber gives proper notice to Lily White Productions, LLC of aforementioned, Subscriber will remain liable to Lily White Productions, LLC for any and all charges for unauthorized use of the Service.

7.  Subscriber hereby agrees that any fraudulent reporting of a lost or stolen credit card used to obtain goods or services from www.lesbianfilm.net or any fraudulent reporting of an unauthorized charge to www.lesbianfilm.net on Subscriber’s credit card which has been made by Subscriber or anyone under Subscriber’s authority, at a time when a charge or other obligation for payment for goods and/or services to www.lesbianfilm.net remains outstanding at the time of such fraudulent reporting, Subscriber shall be liable to Lily White Productions, LLC  for liquidated damages of $25,000.00. The liability for liquidated damages specified in this Paragraph shall not limit any other liability Subscriber may have for breach (es) of any other terms, conditions, promises and warranties set forth in this Agreement.

8. Upon becoming a Subscriber to the Service, Lily White Productions, LLC will furnish the Subscriber with a unique ID and password which allows access to the Service. The ID and password is issued by, our online financial transactions processing company & our authorized sales agent: CC Bill, in the form of a revocable license and remains the property of CC Bill and Lily White Productions, LLC and constitutes proprietary information and are the property of CC Bill and Lily White Productions, LLC. IDs and passwords are non- transferable. Each Subscriber must keep his password strictly confidential. Remember your password! For security reasons, Lily White Productions, LLC will not release passwords for any reason, except as may be specifically required by law or court order. Transfer of any ID or password to another person or entity, or allowing any person or entity other than the Subscriber to gain entrance to the Service via such Subscriber's ID and password is strictly prohibited, and is a breach of this Agreement and a violation of law. The said period lasts from 12:00 midnight EST to 12:00 midnight EST.

 9. Subscriber hereby affirms under oath, warrants and represents that he/she is at least eighteen (18) years of age (21 in some jurisdictions) and has the legal capacity to enter into agreements of this nature. Lily White Productions, LLC makes no representation or warranty that the content published on www.lesbianfilm.net abides with the local laws of your jurisdiction. Subscriber is solely responsible for knowing your local laws concerning standards of content legality for purposes of obscenity laws. Subscriber further represents and warrants that Subscriber understands the nature of the content published on www.lesbianfilm.net, specifically, sexually explicit materials, and that Subscriber voluntarily chooses to view such material, and that such material does not offend or bother Subscriber’s tastes. Should Subscriber not be able to testify to the representations and warranties contained herein, do NOT subscribe to this Service.

10. Subscriber agrees any action on Subscriber’s part to Bookmark to a page on this Website whereby the Warning Page, the Age Verification Page, and/or the Terms Of Service of Membership Page is bypassed shall constitute an implicit acceptance by said person of all the Terms of Service set forth herein as well as an explicit acknowledgment by said person of the fact that said person is an adult and at least 18 years of age or of the age of majority under the laws of said person’s state, province or country.

11. Subscriber further acknowledges and agrees that Subscriber will remain liable to Lily White Productions, LLC for any unauthorized use of www.lesbianfilm.net associated with Subscriber’s Membership.

12. Lily White Productions, LLC has no responsibility for supplying Subscribers with computer equipment or communications connections necessary to access the Service. Subscribers are solely responsible for these items.

13. Subscriber acknowledges that Lily White Productions, LLC does not screen or endorse the content of any advertisements or communications submitted to or posted on www.lesbianfilm.net by third-party licensees, advertisers, users of the Website or other persons, nor does the Lily White Productions, LLC exercise any editorial control, prior screening or supervision over such content. Subscribers are therefore advised to use their own judgment to evaluate all advertisements and other communications available at or through the use of www.lesbianfilm.net prior to purchasing goods and/or services described at www.lesbianfilm.net or otherwise relying on or responding to any communication or information posted on, or accessed through the use of the Website. Subscriber might access some of the content of www.lesbianfilm.net via hyperlinks that will connect Subscriber to third parties, or to third-party websites that may provide content to the Website. Those linked websites are not under the control of Lily White Productions, LLC and Lily White Productions, LLC has no editorial control or supervision over selection or display of the content provided by those third parties or those third-party websites. Lily White Productions, LLC is providing the Subscriber links to those third-party websites only as a convenience, and the inclusion of any link on Lily White Productions, LLC's Website does not imply endorsement by Lily White Productions, LLC of any other website or the content of any such website. The owners and operators of all third-party websites are solely responsible and liable for the content they provide to Subscriber.

All material displayed on www.lesbianfilm.net is copyrighted by Lily White Productions, LLC, or is licensed under copyright by Lily White Productions, and therefore may not be copied, redistributed, or downloaded, in whole or in part, without the written permission of Lily White Productions, LLC.

15. The Service is for the private, non- commercial pleasure of Subscribers only. Any other usage is restricted.

16. There are no facilities provided by the Service for sending or receiving private or confidential electronic communications. All messages shall be deemed to be readily accessible to the general public. Do not use the Service for any communication for which the sender intends only the sender and the intended recipients) to read. Subscriber hereby acknowledges and agrees that all messages entered into this Service can and may be read by the owners of the Service, whether or not they are the intended recipients). The owners of www.lesbianfilm.net and Lily White Productions, LLC will be the sole recipients of any electronic e-mails send to our company but we cannot guarantee that such communication will not be intercepted by a computer “hacker.” This is also true for any e-mail sent to our online financial transactions company, CC Bill. Subscribers are responsible for information they send, or display through the Service even if a claim should arise after termination of service.

17. Notices by Lily White Productions, LLC or our Company’s financial transactions company, CC Bill, to Subscribers may be given by means of electronic messages through the Service, by a general posting on the service. Notices by Subscribers may be given by electronic messages, unless otherwise specified in the Agreement.

18. Under no circumstances, will Lily White Productions, LLC be held liable for, including but without limitation to, any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of or use of records, whether for breach of contract, negligence, or under any other cause or action. Lily White Productions, LLC payment, if any, shall be limited to the amount of membership fee paid by Subscriber. Lily White Productions, LLC will not be liable for any of the various forms of legal damages or punitive damages that result from the use of, or the inability to use this Service. Subscriber specifically agrees that Lily White Productions, LLC is not to be held responsible for any defamatory, offensive or illegal conduct of any user,  or for damages resulting from disseminating, failing to disseminate, or incorrectly or inaccurately disseminating any material, data, or other communication at or through www.lesbianfilm.net.

19. Lily White Productions, LLC makes no warranties or representations as to the information or services provided through or in connection with the service. Subscriber’s usage of the service is at his/her own risk. Lily White Productions, LLC as well as any party involved in creating, delivering and producing the content, is not answerable for any form of legal damages, or punitive damages resulting from the usage of or access to, the service or products or information provided through the service. Lily White Productions, LLC makes no warranty of the usage of the content in terms of their correctness, accuracy, timeliness, reliability or in any other way.

20. Credit card fraud is a felony and Lily White Productions, LLC will aggressively prosecute any Subscriber attempting to misuse a credit card number.  Lily White Productions, LLC tracks every transaction and will utilize all means available to prosecute any person attempting fraud.

21. Subscriber agrees to indemnify and hold harmless Lily White Productions, LLC, www.lesbianfilm.net, their managers, members, agents, independent contractors and employees from against any claims, losses, liabilities or expenses (including attorneys' fees) arising out of Subscriber's breach of any term, condition or promise contained herein. Should any claim for indemnification arise, or should any action be brought by Subscriber or Lily White Productions, LLC, Subscriber agrees to comply with the jurisdiction of the State of Michigan courts.

 22. This Agreement sets forth the full and thorough understanding between Subscriber and Lily White Productions, LLC with respect to its subject matter. This Agreement may be changed upon notice by Lily White Productions, LLC to its Subscribers. Each provision of this Agreement shall survive termination. This Agreement shall be governed by the laws of the State of Michigan for agreements performed within this State.

23. By joining this website, Subscriber hereby affirms that Subscriber has read this entire agreement and that Subscriber agrees to all its terms and conditions and by authorizing the use of your credit card for payment of fees for Subscriber to maintain a membership to www.lesbianfilm.net and for any other charges which Subscriber may incur for goods or services ordered at or in association with the www.lesbianfilm.net.
